These Terms and Conditions govern the use of the Spicewood Tours & Travel website and transportation services. “Company,” “we,” “us,” and “our” refer to Spicewood Tours & Travel. “Customer,” “you,” and “your” refer to the person using our website, making a reservation, paying for a reservation, or receiving transportation services.
By using our website or making a reservation, you acknowledge that you have read and agree to these Terms and Conditions.
1. Transportation services
Spicewood Tours & Travel provides private shuttle transportation services within Spicewood and the surrounding areas.
All reservations are subject to vehicle, driver, route, and scheduling availability. We may use qualified employees, independent contractors, affiliates, or authorized transportation providers to fulfill a reservation where permitted by law.
2. Reservations
Customers must provide complete and accurate reservation information, including:

Passenger name and contact information

Pickup date, time, and location

Destination

Number of passengers
-
Luggage or equipment requirements

Flight, event, or appointment information when relevant

Any requested accessibility accommodation

Any other information reasonably needed to provide the service
A reservation is not confirmed until we issue a confirmation by email, text message, telephone, or another approved method.
The customer making the reservation confirms that they are authorized to accept these Terms on behalf of every passenger included in the reservation.
3. Prices, fees, and payment
Prices may be based on factors including distance, travel time, service type, vehicle type, pickup location, waiting time, tolls, parking, additional stops, and special requests.
The estimated or quoted price and any known mandatory charges will be disclosed before payment or reservation confirmation. Additional charges may apply when the customer changes the service or when circumstances occur that were not reasonably known when the quote was provided.

Services extending beyond the reserved time
A deposit is due at time of booking with final payment due before pickup. You authorize us to charge the payment method provided for the reservation and any properly disclosed additional charges resulting from the service.
Unless expressly stated otherwise, a quote is valid for 14 days and applies only to the reservation details originally provided.
4. Cancellations, changes, and refunds
Cancellations, reservation changes, refunds, waiting periods, and no-shows are governed by our separate Cancellation and Refund Policy, which is incorporated into these Terms.
If these Terms conflict with the Cancellation and Refund Policy on a cancellation or refund issue, the Cancellation and Refund Policy will control.
5. Pickup and waiting time
Customers are responsible for providing an accurate pickup location and being ready at the scheduled pickup time.
Our complimentary waiting period is [15 minutes] for standard pickups and [30/60 minutes] for airport pickups. Waiting-time charges may apply after that period.
A customer may be treated as a no-show if the passenger is not present after the applicable waiting period and we cannot reach the customer using the contact information provided.
Customers are responsible for monitoring flight, event, appointment, and travel schedules unless we expressly agree to monitor them.
6. Travel times and delays
Pickup and arrival times are estimates unless we expressly provide a written guarantee.
Travel may be affected by traffic, weather, road conditions, construction, mechanical issues, law-enforcement activity, public emergencies, passenger delays, or other circumstances beyond our reasonable control.
We will make reasonable efforts to provide timely service and notify customers of significant known delays. However, we do not guarantee that a customer will arrive in time for a flight, appointment, event, connection, or other scheduled activity.
Customers should allow reasonable additional travel time when timely arrival is important.
7. Passenger conduct and safety
Passengers must follow reasonable safety instructions from the driver and must not:

Threaten, harass, or abuse the driver or another person

Interfere with the safe operation of the vehicle

Possess unlawful weapons, substances, or materials

Smoke or vape in the vehicle

Intentionally damage or excessively soil the vehicle

Engage in unlawful, dangerous, or materially disruptive conduct

Exceed the vehicle’s passenger or luggage capacity
We may refuse or end service when reasonably necessary to protect safety, comply with the law, prevent property damage, or respond to materially disruptive conduct.
A refund may be denied when service is refused or ended because of a passenger’s unlawful, dangerous, abusive, or materially disruptive behavior.
8. Seat belts and child restraints
Passengers must use seat belts and other required safety restraints in accordance with applicable law.
The customer is responsible for requesting any required child safety seat before the scheduled service. Customers must provide and install their own child safety seats. A parent, legal guardian, or responsible adult must supervise children during transportation. We do not transport unaccompanied minors unless we have expressly agreed to do so in writing and any required documentation has been completed.
9. Luggage and personal property
Customers must disclose unusually large, heavy, valuable, fragile, hazardous, or specialized items before booking.
We may refuse items that are unlawful, unsafe, improperly packaged, or beyond the vehicle’s capacity.
Passengers are responsible for checking that they have collected their belongings when leaving the vehicle. We are not responsible for lost, forgotten, stolen, or damaged property except to the extent responsibility cannot be excluded under applicable law.
Found property may be stored for [30] days. The customer is responsible for reasonable delivery or shipping expenses associated with returning an item.
10. Cleaning and damage charges
The customer is responsible for damage to a vehicle or excessive cleaning made necessary by the customer or anyone in the customer’s party.
Charges will be reasonably based on the nature of the damage, required cleaning, repair costs, and documented loss of vehicle use. We may charge the payment method used for the reservation after providing notice and supporting information about the charge.
11. Accessibility and accommodations
We are committed to providing transportation services without unlawful discrimination and to complying with applicable accessibility requirements.
Customers may contact us at 830-262-9333 to request a disability-related accommodation or discuss accessible transportation needs. Advance notice helps us coordinate requested services, but we will consider requests made at any time.
Service animals will be accommodated as required by applicable law. Customers will not be charged an additional fee solely because they travel with a qualifying service animal.

12. Alcohol, smoking, and prohibited substances
Smoking and vaping are prohibited in all vehicles.
Alcohol may be consumed only when expressly permitted by the Company and allowed by applicable law. Passengers must comply with all age, container, and conduct restrictions.
Illegal drugs and unlawful substances are prohibited. The driver may end a trip when continued service would violate the law or create a safety risk.
13. Third-party bookings and services
A reservation made through a broker, travel agent, hotel, booking platform, event organizer, or other third party may also be subject to that party’s terms.
We are not responsible for a third party’s website, representations, payment processing, or independent services. Questions about a payment collected by a third party should ordinarily be directed to that party.

14. Website use
You may use our website only for lawful personal or business purposes related to learning about or booking our services.
You may not:

You may view and use the website for its intended purpose. No other use, copying, distribution, modification, or publication is permitted without our prior written consent.
16. Electronic communications
By providing a telephone number or email address, you agree to receive service-related communications regarding your reservation, including confirmations, driver updates, delays, and payment information.
Consent to receive promotional messages is not required to purchase transportation services. Promotional communications, if any, will be handled according to the consent and opt-out choices presented to you.

17. Privacy
Our collection, use, and protection of personal information are described in our Privacy Policy, which is incorporated into these Terms.
18. Disclaimer and limitation of liability
We will provide transportation services with reasonable care and in accordance with applicable law.
To the fullest extent permitted by law, Spicewood Tours & Travel will not be liable for indirect, incidental, special, or consequential losses arising from a delay, cancellation, missed flight, missed appointment, missed event, or interruption caused by circumstances beyond our reasonable control.
Nothing in these Terms excludes or limits responsibility that cannot lawfully be excluded or limited, including any responsibility imposed by applicable consumer-protection, transportation, safety, or other laws.
Any limitation of liability stated in these Terms must be reviewed and approved by the Company’s attorney before publication.
19. Governing law and disputes
These Terms are governed by the laws of [State], without regard to conflict-of-law principles.
